Workers’ Compensation Legislation Introduced

Two bills which would amend the workers’ compensation law have been introduced in the legislature:
- H.B. 122 would amend R.C. 4123.54 and provide that where an employee tests positive through a blood, breath, or urine test for alcohol or a controlled substance not prescribed by a physician, then there will be a rebuttable presumption that the proximate cause of an injury is the alcohol or controlled substance.
- H.B. 180 would amend R.C. 4123.512 and require that the party filing an appeal to the Court of Common Pleas must serve a copy of the notice of appeal to the central office of the BWC in Columbus.
