Coffman, State ex rel. v. Indus. Comm. (3/31/05)

O.A.C. 4121:1-5-23(A) required employer to provide protective equipment which would protect employees from voltage. Where employer did not provide such equipment, but instructed employee in procedure to isolate equipment from voltage, VSSR provision applies; employer cannot use claim of unilateral negligence to avoid VSSR liability because that doctrine only applies where employer has satisfied requirements of safety code and employee’s actions result in safety code violation.
