Commission Adopts Resolution Governing Attorney Fee Authorization Requirements

The Industrial Commission adopted Resolution R03-1-03 which provides requirements for attorney fee authorizations.

The resolution requires that attorney fee authorizations be filed on the form created by the BWC (currently, form C-230).

For forms of compensation other than permanent partial compensation, the attorney fee authorization must be filed no later than the hearing. For permanent partial, the authorization must be filed before the date the order is mailed.

Authorizations must indicate the award to which they apply, and will be valid for 18 months. An authorization can only be cancelled in writing, before the order authorizing payment issues.
