Ohio Workers' Compensation Guide:
Ohio Workers' Compensation Law
The Ohio workers' compensation system is governed by a number of
different sources of law. The basis of workers' compensation
in Ohio is Section II, Article 35 of
the Ohio
Constitution. The Ohio Legislature has enacted statutes which govern the Ohio workers' compensation system. These statutes are contained in the Ohio Revised Code, Chapters 4121 and 4123.
The Ohio Bureau of Workers' Compensation and Ohio Industrial Commission have adopted a number of rules which further govern the Ohio workers' compensation system. These rules are contained in the Ohio Administrative Code, Chapters 4121, 4123 and 4125.
The Ohio Industrial Commission has also adopted resolutions which govern how the Industrial Commission handles certain matters. These resolutions are available on the Commission's web site.
Courts also make decisions on workers' compensation cases which affect how the law is applied, and may affect whether or not an injured worker receives benefits. Our case index has summaries of workers' compensation decisions from the Ohio Supreme Court decisions and the Ohio Courts of Appeal.
