Workers' Compensation Law
The Ohio Workers' Compensation system is governed by a
number of different sources of law.
The system is based on the Ohio
Constitution. Section II, Article 35 of the Ohio Constitution
provides authority for the workers' compensation system.
The Ohio Legislature has enacted a number of statutes
which govern the Ohio Workers' Compensation system. These statutes are
contained in the Ohio Revised Code,
Chapters 4121 and 4123.
The administrative agencies, the Ohio Bureau of Workers'
Compensation and Ohio Industrial Commission have adopted a number of
rules which further govern the Ohio Workers' Compensation system. These
rules are contained in the Ohio
Administrative Code, Chapters 4121, 4123 and 4125.
The Ohio Industrial Commission has also adopted
resolutions which govern how the Industrial Commission handles certain
matters. These resolutions are available on the Commission's
web site.
Courts also make decisions on workers' compensation
cases which affect how the law is applied, and may affect whether or
not an injured worker receives benefits. Our case
