Workers' Compensation Guide:
Hearings
and Appeals Process
Hearings are held by the Industrial
Commission.
The initial decision in state fund claims is made by the
Bureau of Workers'
Compensation. Sometimes the Bureau may refer the matter to the
Industrial Commission for a hearing without making a decision. The
initial decision in self-insured claims is made by the self-insurer.
When a matter is initially determined, it may be
appealed by either side. You may file an appeal from an unfavorable
decision by the Bureau of Workers' Compensation. If a self-insurer
denies compensation or benefits, a motion may be filed to seek a
hearing.
After the initial decision, appeals are handled in the
same manner, through the Industrial
Commission's hearing process.
Note that there are strict time deadlines which must be
followed for filing appeals. These deadlines must be complied with, or
the right to appeal will be forever lost. See our guide to the hearing/appeals process for
