Maximum
Medical Improvement
If the injured worker's condition is at maximum
medical improvement (M.M.I. or MMI) , temporary
total payments are terminated. Maximum medical improvement is
defined by Ohio Administrative Code Section 4121-3-32(A)(1) as "a
treatment plateau." Basically, a condition is at maximum medical
improvement if it is not believed that the condition will change.

- Administrative:
The Industrial Commission has issued a new policy regarding when
hearing officers can make a determination that the injured worker's
condition is at maximum medical improvement. (June 2000)
- Court: The
Supreme Court has decided that where a treating doctor explains an
ambiguous report (and indicates that the injured workers' condition
remains temporary total), that report cannot be used to support a
finding of maximum medical improvement. (March, 1999)

Commission Issues New Resolution applying Russell
decision, which declared Commission Temporary Total Overpayment Policy
Invalid. (August, 1998)
