Alcohol and Drug Use Bill
Passes House
The Ohio House of Representatives has approved H.B. 122,
a bill which would deny workers' compensation benefits to employees who
were under the influence of alcohol or other drugs at the time of
injury.
The denial of benefits would be upheld unless the
injured worker can prove the alcohol or drugs were not the primary
cause of the accident. This bill allows employers to test injured
workers within a "reasonable" time period after an injury through
blood, breath or urine tests.
This legislation goes to the Ohio Senate for
consideration.
